PLEASE READ THIS AGREEMENT CAREFULLY. This is a binding agreement between Customer and GRUPO HOST and includes automatic renewal terms. By submitting an Order Form online or by using Products and Services, Customer hereby agrees to the terms and conditions of the Agreement. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
Changes to this Agreement
From time to time, GRUPO HOST may change this Agreement. GRUPO HOST will provide you with notice of material changes via the e-mail address associated with the Customer’s account, and by posting online at https://www.grupo.host/legal/. It is your responsibility to check for any such notices. Your continued subscription to and payment for GRUPO HOST’s services after the effective date of the change constitutes your acceptance of such changes. GRUPO HOST is not making any representation regarding the availability of any Product or Service, which may be changed of discontinued.
Customer Cancellation or Non-Renewal
In order to cancel or elect not to renew any Product or Service, Customer must login to Customer’s GRUPO HOST control panel, go to the device Customer wishes to cancel, click the cancellation button, and fill out the form. All account cancellations must be received in the above manner at least fifteen (15) days in advance of the date of renewal. Accounts cancelled with less than fifteen (15) days notice shall be cancelled at the end of the next term and shall be charged accordingly. When a cancellation request is made, GRUPO HOST will immediately remove all configuration information as well as all contents of the account on the date of the next renewal of the account. Customer may request immediate cancellation if so desired. GRUPO HOST will remove all files. This may include unread e-mail left on the server.
CUSTOMER ACKNOWLEDGES AND AGREES THAT ALL PRODUCTS AND SERVICES SHALL CONTINUE TO RENEW AND CUSTOMER WILL CONTINUE TO BE BILLED FOR ALL PRODUCTS AND SERVICES UNLESS CUSTOMER CANCELS THE PRODUCTS AND SERVICES AS PROVIDED IN THIS SECTION.
TERMS AND CONDITIONS
GRUPO HOST will provide and manage all the licenses that may be necessary for use of the web hosting service.
GRUPO HOST will keep you your services active, and will correct any situation that could arrive as soon as technically possible. In case that the client do not pay on time, the services could be suspended at any time.
In case the payment is not processed in time, the service can be interrupted without previous warning. The CUSTOMER may re-activate making outstanding payments, late fees may apply.
All plans and products automatically renew unless you cancel. You may cancel at any time, prior to your renewal date, by logging into your account online or by calling customer support.
In case of being a DOMAIN NAME and not having renewed in time according to the registry and the policies, GRUPO HOST will not be responsible for the possible loss of the domain.
The CLIENT must provide correct data and updates of the same once they change, including full name, valid electronic mail(s), telephone, and physical address to be accepted as a customer.
GRUPO HOST is not responsible for the content of your page, opinions or ideas expressed therein. The CLIENT is responsible for the files, texts, images and general content hosted in the CLIENT's hosting account.
In case your service have conflicts with the LAW, attacks against the security or integrity of the servers, networks or others of this nature, GRUPO HOST could give personal information, if necessary. The CLIENT will be solely responsible for damages or consequences related.
Virus replication or hosting them in the server is not allowed. In case any abuse, attacks or related actions are detected harmful, GRUPO HOST could suspend the service without prior notice.
Prohibited Uses of GRUPO HOST Hosting Systems and Services:
Transmission, distribution or storage of any material in violation of any applicable law or regulation is prohibited. This includes, without limitation, material material protected by copyright, trademark, trade secret or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
Unacceptable practices include but are not limited to:
Drug dealing
Piracy/Pirating
Violation of copyright law
Illegal gambling/Lottery sites
Illegal arms trafficking
Stalking or violating state or federal law.
Attempting without authorization to access a computer system
Schemes to defraud, sending a message or having content that is indecent according to American laws with intent to annoy, abuse, threaten, or harass another person
Threatening bodily harm or damage to individuals or groups
Violating U.S. and International Export restrictions
Interfere with or disrupt the Services or servers or networks connected to the Services, or disobey any requirements, procedures, policies or regulations of networks connected to the Service
Any service that promotes any of the above content, would be subject to immediate cancellation of your account without prior notice and without option a possible refund.
GRUPO HOST reserves the right to change the technology used. Such change will be communicated in advance to the CLIENT so that it has minimal repercussions.
By registering with GRUPO HOST or any other related service, you grant a license, free-worldwide, without restriction to use, copy, transmit to the public, display, create compilations, and re-distribute such page on the internet , and any associated content, for limited purposes to publish, promote, promote through the web and emails, main reason why the CLIENT decided to contract the service.
In shared hosting account there is a maximum possible per account divided into the total available and set for users for an amount of (25%) of the total resources of a CPU (processor) and RAM. These limitations are not related to the web space or monthly bandwidth transfer which are regulated according to the plan acquired by the CLIENT.
Use of inodes per account / hosting package. In shared plans, the inode limit is 2,500,000.00 to 7,500,000 (7 million, 500 thousand) inodes according to the selected package, and in Superior Business plans or Dedicated Servers there are no established limits for the availability of inodes (being the total contracted available according to to the selected space). The violation of these policies supposes a direct violation of the terms and conditions, reason that could cause a temporary, immediate or definitive suspension of the services. INTODOMAIN will inform the client and give a prudent period of 24-72 hours.
GRUPO HOST will provide a corrective maintenance service, and will solve any incident in the shortest possible time.
GRUPO HOST can cancel the service for non-payment of invoices, and a temporary suspension on the expiration of the renewal date. The service may be re-established once the payment has been confirmed.
GRUPO HOST does not guarantee the total privacy of the files, databases and information, being exempted from all legal responsibility that may derive from obtaining by third parties through the web or other means.
GRUPO HOST will not be responsible for interruptions or malfunction of the service motivated by force majeure, unforeseeable event or for reasons beyond the control of GRUPO HOST.
The CLIENT acknowledges that the coverage and quality of the service could be altered by exceptional circumstances that prevent the level of service required.
Using a shared hosting account as a backup device "(Backups)" is not permitted, with the exception of a backup copy of the same cPanel account and its web-related files and emails. The CLIENT acknowledges that this is against the terms and conditions of use, reason why the service could be suspended or canceled without option to refund.
GRUPO HOST offers up to 10GB for database use in shared hosting plans. In case the client overcomes the use, it should migrate to a dedicated plan or other data base service option available. In case the client does not comply with its limits in a time of 72 hours, the service would be subject to immediate suspension.
BACKUP POLICY
GRUPO HOST offers free backup service as courtesy, these backups are auto re-generated every week or monthly basis depending on the hosting plan adquired. This service is offered at no additional cost to shared hosting accounts that do not exceed 30GB of storage. In case of exceeding this limit, the client will be able to generate and download backups by cPanel or using FTP. This service is complimentary and no guarantees are provided.
Cloud Bussines hosting plans are offered without any type of limitation, making backups of these independently the space in use.
The automatic backup service of GRUPO.HOST is executed once a week, on a random day, and each execution overwrites the previous backups. The terms of our backup policy vary depending on the type of service/hosting account.
GRUPO.HOST backups are provided as a courtesy and are not guaranteed to be error free, or always available. Customers are responsible for making their own backups.
If an account is eliminated or in case you cancel your service/hosting account, all backups will be immediately deleted.
STORAGE AND SAFETY: You will be solely responsible for taking steps to: (1) prevent any loss or damage to your website or stored content; (2) maintain separate files and backups of your website or content; And (3) ensure the security, confidentiality and integrity of all content transmitted or stored on our servers.
GRUPO.HOST requires a $ 20 USD fee to restore a weekly backup. However, you can always restore your own backups files, and no fee will apply. We offer all the tools and an easy control panel in order that they can openly perform, restore or manage your backups in real time.
SERVICE LEVEL AGREEMENT
The problems will be solved in a period of 2 hours to a maximum of 2 weeks depending in any case on the magnitude of the problem. GRUPO HOST guarantees that everything will be corrected as soon as possible.
Critical incidence is understood as: the incidences that, in the framework of the provision of the service, significantly affect the CUSTOMER.
It is understood by severe incidence: the incidences that, in the context of the provision of the service, affect the CUSTOMER moderately.
It is understood by slight incidence: the incidences that are limited to obstruct the provision of the service.
The repair will be made in the following maximum periods from the notice:
Critical Incidence: 2 hours - 2 weeks
Severe incidence: 4 hours - 2 weeks
Slight incidence: 8 hours - 2 weeks
The status of the service is analyzed daily to check its proper functioning.
RESOLUTION
The contract may be resolved by the general causes of termination of the contracts.
The CUSTOMER may terminate the contract at any time, communicating in writing to GRUPO HOST, at least 15 days in advance.
GRUPO HOST may terminate the contract in case of non-payment of invoices by the CUSTOMER.
The contract will be automatically resolved by the loss by GRUPO HOST of the license or permits necessary to provide the service.
DECIMA. - NOTIFICACIONES
Notifications made between the Parties will be by mail, telephone or virtual office (client area, web based). GRUPO HOST will notify expirations, notices, and renewals by e-mail and will be sent to the email addresses registered by the CLIENT.
By using the service, the CLIENT accepts that GRUPO HOST is excluded from any liability that may be caused by the unauthorized handling of the trademarks or other intellectual property rights of third parties or linked content. Likewise, any references to any product, service, process, linked site, hypertext or any other information in which trademarks, distinctive signs and / or domains are used, trade name or the name of the manufacturer, supplier, etc; Which are owned by third parties, shall at no time constitute, nor imply any protection or recommendation by GRUPO HOST, and in no case shall GRUPO HOST stipulate ownership or responsibility over them. Any dispute, controversy or claim between the owner of a domain name and GRUPO HOST resulting from the application of these policies or related to them, their non-compliance, interpretation, resolution or nullity shall be resolved by direct agreement between the client and The holder, in its absence, will be submitted to the Arbitration administered by the Conciliation and Arbitration Council of the Chamber of Commerce and Production of Santo Domingo, Inc. These disputes submitted to arbitration will be resolved in accordance with the provisions established in Law 50- 87 dated June 4, 1987 on Chambers of Commerce and Production; Its amendments contained in Law 181-09 and Law 489-08 of December 19, 2008, on Commercial Arbitration; The Rules of the Arbitral Tribunal of the Chamber of Commerce and Production of Santo Domingo, Inc., as well as any other applicable legislation in force in the Dominican Republic. The arbitrators will decide in law and may request the execution of precautionary measures. The SUPPLIER is not responsible for legal costs, so the owner and the client will be solely responsible for expenses generated through the controversy.
GRUPO HOST does not guarantee that the service will not be interrupted, but will guarantee up to 99% the availability of the service. To the fullest extent permitted by law, GRUPO HOST is excluded from all liability with respect to accuracy, content or availability of information. The services on this site are provided "as is" and without warranties, expressed or implied.
Any product or service available to users of this page are provided by third parties who are not necessarily affiliated to GRUPO HOST, to the fullest extent permitted by law, GRUPO HOST is excluded from all liability under any circumstances (including negligence) for any Special or consequential damages resulting from the use, or the inability to use the materials of our service.
